High Court ruling paves way to ban Finks

The High Court has upheld Queensland's criminal association laws, with the decision clearing the way for an application to ban the Gold Coast chapter of the Finks motorcycle club.
Queensland police applied to the Supreme Court to ban the Gold Coast chapter of the Finks motorcycle club last June under the state's Criminal Organisation Act.
But both parties agreed to put the case on hold while the High Court determined whether the laws were valid.
Today, the High Court has ruled Queensland's laws are constitutional.
The High Court had already overturned similar laws in South Australia and New South Wales.
Queensland Premier Campbell Newman has welcomed the ruling.
"This means that we can wage the fight against criminal outlaw motorcycle gangs - people who deal in drugs, people who deal in prosecution and organised criminal matters," he said.
"These sorts of powers and these laws are essential to take the fight up and protect all Queenslanders."
The lawyer representing the Gold Coast chapter of the Finks, Bill Potts, says the group will continue to argue their case in the courts.
Mr Potts says the court did place conditions on the use of secret intelligence.
"The police are going to have to go back to the drawing board and provide significantly greater detail as to what their case in fact is about," he said.
He says the majority of Finks members have a high regard for the law and will continue to fight for justice.
Mr Potts had argued the laws were unconstitutional because they impose a sanction without a criminal trial.
He also argued court could make its ruling based on secret criminal intelligence kept from those affected.
But the High Court has upheld the validity of those provisions.
The High Court found although the provisions are a departure from usual practice, the court is still able to act fairly and impartially.
The ruling means the Supreme Court can now consider the application to ban the group.
However, Mr Potts says police will have to amend their Supreme Court application seeking to have the Gold Coast chapter of the Finks outlawed.
"While they are able to rely upon secret intelligence, the High Court has said firstly the Supreme Court is able to ensure fairness to the Finks and to any other person who's the subject of this legislation," he said.
"But it requires the police to step out in great detail exactly how the evidence comes about and what their case is."

Arrest over armed robbery – Robina

Police have charged a man in relation to the armed robbery of a bottleshop at Robina last Tuesday March 12, 2013.
During the armed robbery it is alleged a handgun was used to obtain money from console operator at the Ron Penhaligon Way business.
A 35-year-old man from Robina has been charged with armed robbery.
He is expected to face Southport Court today.

UPDATE: PSPA revoked, Brisbane City

An emergency situation declared under the Public Safety Preservation Act (PSPA) in Brisbane City this morning has been revoked.
The emergency situation was declared at 11.20am after police received reports of an armed person in Queen Street Mall.
Police used less than lethal rounds to subdue a 34-year-old man before taking him into custody.
The man was transported to Royal Brisbane Hospital with non life-threatening injuries.
As per standard practice, Ethical Standards Command will overview an investigation into the appropriateness of the police action in resolving the incident.

IMPORTANT INFORMATION.

To residents of the Coomera & Gold Coast Police Districts.

 
The theft of fuel has been a big problem and the amount of offences being reported to police has been increasing. In just one police stations area of responsibility, from 1/1/13 to 21/2/13 - 117 offences were reported in that area alone. On average, each investigation can take 1 to 3 hours of police time. By reducing the amount of petrol drive off offences that police have to investigate, we will be effectively making more police time available to respond for calls for service.

I am advising you all of some changes that are happening at a number of petrol stations around Coomera and the Gold Coast. Petrol stations are going to be following police suggestions to try and reduce the amount of theft of fuel offences that are occurring. Basically a large number of offences are being committed in stolen vehicles or whilst the vehicle has false number plates attached. The majority of offenders are wearing some item or article that defeats the camera surveillance and prevents them from being identified. Generally offenders are not first time offenders and as a result would be able to be identified by police. If offenders are forced to remove these items prior to the petrol pump being turned on – they risk being identified by police so they will not take the item(s) off and drive away without stealing fuel. (They are then likely to go to another petrol station that does not follow this procedure – but hopefully all petrol stations will soon adopt these procedures.)

Unfortunately law abiding citizens are going to be slightly inconvenienced by being asked to remove any item that can hinder visual identification. We are asking you to remove these items and look towards the camera(s); the fuel pump will then be turned on. You are welcome to put the item(s) back on when the pump has been activated. If for any personal, medical or religious reason you do not wish to remove such items you may be required to produce identification or pre-pay for your fuel before the fuel pump is turned on.

To date, 18 service stations, being Freedom fuels, 7-11 stores & some BP service stations have had signs fitted are adopting these procedures. You will be able to identify these petrol stations as their pumps have the following signs attached.

Please be patient and co-operate with the petrol stations.

Please spread this information to others. Help make it harder for offenders to steal fuel.

"SCREW - CRIME"

In the Coomera Police District there has been a large quantity of NUMBER PLATES STOLEN from vehicles. Some of the stolen number plates are being used to evade identification in various crimes such as stealing of petrol and robbery, or to avoid paying for tolls. When a number plate is stolen it can quite often result in greatinconvenience to the victim such as; reporting the matter to police; the possible numerous statutory declarations & letters to explain that it was not your vehicle involved when the stolen plate is photographed on a speeding vehicle or going through a toll booth.
Crime prevention initiative – FREE OF CHARGE.
As part of our Crime Prevention Initiative we are offering to supply and fit FREE of charge, one way screws to secure number plates of patrons’ vehicles. When this type of screw is fitted it makes the removal of the number plate very difficult – deterring the theft of that number plate.
